This is assuming that you did not apply your H1 through a bidy shop but an actual company.. Here are the answers:
1. Seems like your H1 was approved but you never received a hard copy, which yes is important to get SSN. Without H1 you won't get SSN and without SSN you won't get paid.
2. I have read on other post on IV that if the employee does not join the job within 30 days then H1 gets void, so seems you are out of status, as you did not join the job, which I assume had stating date of October 1st 2008. If not then you might still be good..
Unfortunately you cannot go back on H4 as your H1 was approved.
I believe you need to get hold of that H1 approval notice ASAP and hire a new attorney. A good attorney might be able to help you..

I came to US on March 28th 2008 on H4 Visa and applied on March 29th for new H1B with COS for Oct 2008 quota. I see the h1b approval of I129 petition on Jun 2, 2008 WITH attached I-94 WITH IT. Till today I have not received approval notice from my employer and did not applied for SSN and has not started working for my employer. On contacting my employer they told I am still on H4 status and will be on H1B status only if I apply for SSN. Please verify if tht is correct.Also i dont have any paystubs uptil now.I need your help to understand my status right now in U.S and what is the right action to take now .
My H4 stamp in passport is till Oct 10th 2009 and my husband is right now working on H1B status.

I have had Lingo since 2005 and have never faced any issues with it. Call quality has always been excellent and although their CS used to be pretty horrible, of late it has definitely improved.
I was on the Unlimited USA/Canada plan till late last year when I heard about Unlimited Asia for 29.95 w 2.9c/min to India. I switched over then and they credited the plan change fee of 9.99. Couple of months ago when they launched the Hello World plan for 21.95 w the same 2.9c/min to India I called and switched over and there were no issues. I did have to call once again to get the Plan change fee of 9.99 credited since I think their software applies it automatically but I didnt have any issues.
2 days ago I called to switch over to the Unlimited Plan and it was done, no issues. I probably will have to call after next month's invoice to get the Plan change fee credited.
Overall no issues. Ping me if you need a referral.

I am not sure about what you mean by "reveal why it is pending" when we are talking about background check.
If your case is pending from long time and your dont know why its pending. You might ask congressman and he might help you. In case if reason is back ground check he will tell you its pending because of backgournd check. He wont help you more in backgound check.
If you already know that your case pending because of background check and if you ask congressman to help in this. he will not help you and wont reveal any extra detail to you. In my case I knew that my case is pending because of background check and I asked congressman to help in this he didnt help me at all.

My passport with US visa wa damaged, so indian consulate gave me a duplicate passport in lieu of of damaged passport and retained the damages passport with them. Fought bitterly wiht the consulate for the old one, but of vain. Now i have a blank passport with approved H1B approval notice I-797. After 5 years going to India, and has to go for VISA stamping.
Do you see any issues with my VISA being rejected in India?
I was reading on this forum that, without a visa (either expired or valid) stamp most european airlines won't even allow to board the flight, is it true?
If this is true, what airlines should i travel with out any hessle?
Working with a reputed firm, has I140 approved .. waiting for 1485 priority dates.
Do you have a copy of the old -damaged passport? If you dont, your employer will surely have it on their file.

I am not new to this...same thing happened to me when I did fingerprints for canadian immigration as well. For canadian immi. I had to do it 3 times and since it wasn't electronic machine it tool 4-6 weeks each time just to get the results that FPs are not readable. At least that way this is better I think, we know the results in the second week.
